Confident French is a French tuition business providing French lessons, educational resources and related services.

Confident French provides French tuition and educational resources, which may include:

• one-to-one French tuition
• GCSE French tuition
• online group classes
• revision and exam preparation sessions
• masterclasses
• downloadable educational resources
• worksheets, vocabulary resources and phrase banks
• other French-learning materials advertised on the website.

The content, format, availability and price of each service will be stated on the relevant website page at the time of booking or purchase.

Lessons must be booked through the booking system, by email or by another method agreed with Confident French.

A lesson is considered booked once the booking has been confirmed by Confident French and, where applicable, payment has been received.

Lesson times are subject to availability.

For students under 18, the booking and contractual agreement should normally be made by a parent or legal guardian.

The current price of each service will be displayed on the website or communicated to the customer before booking.

Payment must be made using the payment method provided by Confident French.

Unless otherwise agreed, payment is required in advance.

Confident French reserves the right to change its prices. Any price change will not affect a lesson or service that has already been paid for.

Confident French understands that circumstances can change and will always try to be reasonable where possible.

Customers should give at least 24 hours’ notice if they need to cancel or rearrange a lesson.

Where sufficient notice is given, Confident French will normally offer a rearranged lesson, subject to availability.

Where a lesson is cancelled with less than 24 hours’ notice, or a student does not attend a booked lesson, the lesson may be charged in full.

Confident French may make exceptions where there are genuine exceptional circumstances.

If Confident French needs to cancel a lesson, the customer will be offered an alternative lesson time or, where appropriate, a refund.

If a technical problem prevents a lesson from taking place, Confident French will make reasonable efforts to rearrange the lesson or provide an appropriate alternative.

Online lessons require the student to have:

• a suitable device
• a reliable internet connection
• access to the agreed online platform
• a suitable environment in which to participate.

Students are responsible for ensuring that their equipment and internet connection are working before the lesson.

If a student’s technical problems significantly reduce or prevent a lesson from taking place, the lesson may still be chargeable.

If the problem is caused by Confident French or its chosen online platform, reasonable steps will be taken to rearrange or otherwise resolve the lesson.

Students should attend lessons promptly.

If a student arrives late, the lesson will normally still finish at the scheduled time.

Where a student is late without contacting Confident French, the lesson may be treated as a missed lesson. The student may of course join in at any time during that lesson.

For students under 18, a parent or legal guardian is responsible for making the booking and providing the necessary consent.

Parents or guardians should ensure that they are aware of the lesson arrangements and have provided any information reasonably required for the safe and effective delivery of the service.

Confident French will maintain appropriate professional boundaries when communicating with students.

Where appropriate, communication about bookings, payments and other administrative matters will be with the parent or guardian.

Confident French aims to provide a friendly, respectful and supportive learning environment.

Students are expected to behave respectfully towards their tutor and, in group classes, towards other students.

Confident French reserves the right to end a lesson or remove a student from a group class where behaviour is seriously disruptive, abusive, threatening or inappropriate.

Where a lesson is ended because of serious inappropriate behaviour, a refund will not necessarily be provided.

Where a student books an online group class:

• the student is expected to attend at the scheduled time;
• the class will normally continue even if an individual student is unable to attend;
• missed group classes are not automatically refundable or transferable;
• class size and content will be as advertised at the time of booking.

Where Confident French cancels or significantly changes a group class, an appropriate alternative or refund will be offered.

All worksheets, PDFs, vocabulary lists, phrase banks, videos, lesson materials and other resources created by Confident French remain the intellectual property of Confident French unless otherwise stated.

Purchased resources are supplied for the customer’s personal educational use.

Customers must not:

• copy and redistribute resources;
• resell resources;
• upload resources to public websites or social media;
• share paid resources with other students;
• reproduce resources commercially;
• remove Confident French branding and claim the material as their own.

Teachers, schools, tutors or other organisations wishing to use Confident French resources commercially must obtain written permission.

Digital resources will normally be made available electronically following purchase.

The customer is responsible for ensuring that their device can open and use the purchased file or resource.

Because digital products can be supplied immediately, specific rules apply to cancellation rights for digital content. Where required, customers will be asked to expressly agree to immediate supply of the digital content and acknowledge the effect this may have on their cancellation rights. GOV.UK specifically requires this for immediate digital downloads.

Nothing in these Terms & Conditions affects a customer’s statutory rights.

Where a customer has a legal right to a refund, cancellation or other remedy, Confident French will comply with those rights.

For voluntary cancellations, the applicable cancellation policy will be displayed before the customer completes the booking or purchase.

Where a service is purchased online, consumer cancellation rights may apply.

Customers will be provided with the legally required information about cancellation before entering into the contract.

Where a customer asks Confident French to begin providing a service during the statutory cancellation period, the customer may be asked to expressly request this.

Where the law permits an exception to the statutory cancellation period, this will be explained to the customer before the relevant service or digital content is supplied.

Confident French will provide tuition, guidance and educational resources with reasonable care and skill.

However, Confident French cannot guarantee a particular GCSE grade, examination result or other academic outcome.

A student’s progress depends on a range of factors, including attendance, effort, independent study, prior knowledge and examination performance.

All original content on the Confident French website, including text, graphics, logos, branding, worksheets and other materials, belongs to Confident French or is used with permission.

Website content must not be copied, reproduced or commercially exploited without written permission.

Confident French aims to keep the website accurate and available but cannot guarantee that the website will always be available or free from technical errors.

Confident French may update, change or temporarily suspend parts of the website where necessary.

The website may contain links to third-party websites or services.

Confident French is not responsible for the content, availability, security or privacy practices of third-party websites.

Confident French collects and uses personal information in accordance with its Privacy Policy.

The Privacy Policy explains what information is collected, why it is collected, how it is used, how long it is retained and the circumstances in which it may be shared.

Confident French takes the safety and wellbeing of students seriously.

Where a safeguarding concern arises, Confident French may take appropriate action, which may include contacting a parent or guardian or, where necessary, an appropriate external organisation.

Confidentiality cannot be guaranteed where disclosure is necessary to protect a child or another person from harm.

Confident French will aim to respond to complaints within 2 working days.

Confident French may update these Terms & Conditions from time to time.

The version that applies to a booking or purchase will normally be the version in force at the time the booking or purchase was made, unless a change is required by law.

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales, subject to any rights the customer may have under applicable consumer protection law.
